A francesa Vinci abriu hoje uma garrafa de Dom Prignon

ANA, monopólio público passa a monopólio privado? Pelos vistos, ninguém perguntou.

Será que algum partido, ou arara delegada no parlamento português, ou ainda a deputada europeia do MRPP sempre preocupada com fenómenos de corrupção em Angola, fez alguma pergunta à Comissão Europeia sobre se estaria ou não em causa, na privatização da ANA, a substituição de um monopólio público por um monopólio privado? A venda da ANA à parelha Vinci-Mota-Engil foi feita ao abrigo de que Caderno de Encargos? Alguém conhece o dito, incluindo todos os seus anexos? E a Comissão Europeia, que decidiu, conhece?

O Jornal de Negócios apressou-se a escrever que:
“Bruxelas concluiu que a operação de privatização, prevista no programa de assistência financeira, não viola as regras comunitárias de concorrência.” 
Ma não viola memo? É? Alguém preguntou? O Rui Moreira preguntou? O Belmiro preguntou? O Louçã preguntou? O Jerônimo preguntou? A Ana Gomes preguntou?

A pergunta teria que ter sido endereçada a Bruxelas até ao passado dia 19 de maio.

Reparem nesta frase da notificação oficial da UE:

“— for undertaking ANA: management and operation of airport infrastructures in Portugal.”

É que na comunicação de hoje que autoriza a fusão da Vinci com a ANA, por aquisição de posição maioritária no capital desta última, nada se diz sobre a natureza e/ou potencial eventualmente monopolista da ANA, e portanto da futura ANAVINCI. Ora vamos lá a ler:

Mergers: Commission clears acquisition of Aeroportos de Portugal by VINCI
The European Commission has approved under the EU Merger Regulation the acquisition of Aeroportos de Portugal (ANA) by VINCI of France. ANA manages and operates airport infrastructures in Portugal. VINCI is a diversified group, active among others in the fields of (i) concessions and infrastructures, mainly motorways and parking lots, as well as airports in France and in Cambodia (ii) electrical engineering (iii) climatic and mechanical engineering. The proposed transaction is the result of a tender procedure launched by the Portuguese State in the context of ANA’s privatization. This privatisation is part of the Economic and Financial Assistance Programme provided to Portugal by the European Union, the European Central Bank and the International Monetary Fund. The Commission assessed the effects of the proposed acquisition on the markets for the award of airport management and operation concessions, and for the management and operation of airport infrastructure in Portugal, as well as vertical relationships of these markets with the upstream markets for electrical, mechanical and climatic engineering services, where VINCI is active. The Commission's investigation found that the transaction would not raise competition concerns. The merged entity would indeed be unable to shut out suppliers on the upstream markets for electrical, mechanical and climatic engineering services because of the numerous credible competitors. It would also be unable to shut out customers because it is a very small customer of electrical, mechanical and climatic engineering services. Volto a perguntar: a frase que se segue e faz parte da fundamentação da decisão de Bruxelas pressupõe que não há monopólio na gestão e operação dos aeroportos civis de Portugal. É assim, ou vem coisa contrária escrita nalgum anexo do contrato de concessão?

“— for undertaking ANA: management and operation of airport infrastructures in Portugal.”

Eu sei que já passou o dia 19 de maio, mas faço na mesma a pergunta ao senhor Barroso, à Comissão Europeia, aos organismos que normalmente vigiam as muitas fraudes, descaradas, ou dissimuladas, que ocorrem nos negócios europeus intra-comunitários, e à sempre diligente diplomata deputada do MRPP, Ana Gomes: a ANA da Vinci e da Mota-Engil permanece ou não um monopólio, como tem sido até hoje?
